Ms. S was riding her bicycle in a designated crosswalk when she was wrongfully struck by an automobile which blew through a red light. She sustained multiple contusions, abrasions and lacerations, some of which required sutures.
The insurance carrier disputed liability claiming that the light was yellow and that Ms. S. was crossing on a red and should have been walking her bike instead of riding it in the cross walk. They also disputed the extent Ms. S’s injuries claiming that she was exaggerating her injuries.
